An arrest for drunk driving can set off a chain of events that can move quickly. If you have been arrested for DUI, you may be facing a criminal charge with the potential to affect your freedom, your finances, your reputation, and your future. Virginia's DUI laws are strict, and the courts take these cases seriously. What you do in the aftermath of an arrest can shape everything that follows.

At Robinson Law, PLLC, our lawyers represent people throughout Mount Vernon and the greater Fairfax County area who are facing DUI charges. We believe that every person deserves a thorough, thoughtful defense, and we are committed to providing effective legal representation while protecting our clients' interests. We will examine the facts of your case carefully, determine whether evidence may be challenged, and work to achieve results that will protect your life and your future.

Alcohol, Driving, and the Signs Officers Look For

Alcohol affects the brain and body in many ways that can impact a person's driving ability. Even relatively low amounts of alcohol can lead to impairments. In DUI cases, officers will look for certain signs, and arrests will be based on observations indicating that a person is intoxicated.

When a person has been drinking alcohol, their central nervous system will be affected. Reaction times will become longer, and vision may be affected, making it more difficult to judge distances and track moving objects. Coordination can also suffer, affecting fine motor control. As a person's blood alcohol concentration (BAC) increases, these effects will become more obvious.

Law enforcement officers are trained to look for specific signs of alcohol impairment from the moment they decide to pull a vehicle over. They may observe potential signs of impairment before pulling a driver over, such as weaving across the road, abrupt braking, inconsistent speed, wide turns, or other unsafe driving patterns. During a traffic stop, they will be looking for multiple types of physical symptoms or behaviors. The odor of alcohol in a vehicle or on a person is one of the most common observations noted in police reports. Officers will also look for red eyes, flushed skin, delayed or slurred speech, slow or fumbling movements, and difficulty following instructions or answering questions.

Observations of one or more of these factors or anything else that raises suspicions about alcohol impairment may lead an officer to proceed with field sobriety testing or a preliminary breath test. However, many of these signs may not have anything to do with alcohol. Allergies may lead to red eyes. Fatigue or nervousness may lead to fumbling movements. Our attorneys can carefully review the observations documented by an officer and provide other explanations for a person's behavior.

Field Sobriety Testing

To get additional information that may provide them with a reason to arrest a person for DUI, an officer may ask a driver to take certain physical tests known as field sobriety tests. The three primary tests that are commonly used by police officers in Virginia include having a person balance while standing on one foot, observing them as they walk along a straight line, and instructing them to follow a moving object with their eyes. These tests are meant to measure a driver's potential level of impairment, but as with other observations, a person's performance may have nothing to do with alcohol.

The conditions of field sobriety tests can affect the results. Uneven pavement, gravel, sloped roads, poor lighting, and weather issues like wind or rain can all affect a person's balance and coordination. Physical conditions such as inner ear disorders, knee or ankle injuries, or obesity may affect a person's ability to balance. Anxiety can affect a person's concentration and coordination. Our lawyers can evaluate whether tests were performed correctly and whether other factors may have led to misleading results.

Drug-Impaired Driving

Many DUI cases in Virginia may involve drug impairment. A person could face DUI charges if they are accused of driving while impaired by marijuana, cocaine, methamphetamine, heroin, prescription opioids, sleep aids, muscle relaxants, or any other substance that affects their ability to operate a vehicle safely. Even if a medication had been legally prescribed, DUI charges may apply if a person's use of the drug led to impaired driving.

Unlike alcohol, which has a legal limit that can be measured, most drugs do not have a clearly defined amount that will result in intoxication. This may make it more difficult for prosecutors to prove that a person was intoxicated, since the presence of drugs in their system does not necessarily mean that they could not drive safely.

Defense Strategies in Mount Vernon DUI Cases

At Robinson Law, PLLC, our attorneys will review everything that happened during an arrest for DUI. We will identify the opportunities for defense based on improper procedures by police officers or other factors. Some potential steps we may take include:

Evaluating the Legality of a Traffic Stop

An officer's decision to pull a driver over must be based on a reasonable suspicion of a traffic violation or criminal activity. If the officer who stopped your vehicle did not have a legal basis for doing so, our lawyers may challenge the stop itself. Evidence gathered during an unlawful traffic stop, including field sobriety test results or other observations made by an officer, may be excluded from a DUI case, which can weaken the prosecution's arguments.

Challenging Field Sobriety Test Results

While field sobriety tests are meant to provide standards that can be used to determine whether a person may be intoxicated, they ultimately come down to an officer's interpretations of a person's behavior. Our lawyers can review dashcam or body camera footage captured during the stop, looking at the conditions on the road during testing, the officer's training, whether they provided the right instructions, and physical or medical factors that may have affected a person's performance. We may be able to provide explanations for a person's performance and show that they "failed" for reasons other than intoxication.

Contesting Chemical Test Evidence

Breath tests and blood tests will typically be performed at a police station after a person has been arrested for DUI. With our understanding of the factors that may affect these tests, we can determine whether their results may be challenged. For breath tests, our attorneys can look at calibration and maintenance records or review an officer's qualifications to determine whether they followed the right testing protocols. We may argue that conditions such as acid reflux or diabetes led to inaccurate breathalyzer test results.

For blood tests, we can review the chain of custody of a blood sample from collection through laboratory analysis, storage conditions, procedures followed during testing, and the qualifications of the analysts involved. A contaminated sample, gaps in the chain of custody, or laboratory errors may be reasons to challenge blood test results.

Addressing Drug-Related Evidence

In cases involving allegations of drug impairment, our attorneys may review the procedures followed during evaluations by drug recognition experts (DREs) and the reliability of blood test results. We can also take steps to address the difference between the detection of a substance and proof of impairment as we work to prevent a criminal conviction.
