Penalties for Identity Theft in Virginia

If the total fraud amounted to less than $1,000, then the violation will be charged as a Class 1 misdemeanor, carrying up to a year in jail and a fine of no more than $2,500. At $1,000 or more, the charge becomes a Class 6 felony, with a prison sentence of one to five years and a fine of up to $2,500 upon conviction.

In addition, large-scale identity theft schemes come with harsher punishments. If five or more people had their identifying information compromised as part of the same scheme or pattern of behavior, the charge increases to a Class 5 felony, with one to 10 years in prison and a possible $2,500 fine. If 50 or more people were victimized in an identity theft scheme, then the charge further escalates to a Class 4 felony, with two to 10 years in prison and a fine no greater than $100,000.

Alongside criminal penalties, a judge may order restitution to be paid to the victim or victims during sentencing.
