  • Second Offense Within Five to 10 Years: A person will be required to serve a jail sentence of at least one month, and the mandatory minimum sentence is 10 days. The mandatory minimum fine is $500.
  • Third Offense Within Five Years: A third DUI offense is a Class 6 felony, and a conviction can lead to a maximum sentence of five years. The mandatory minimum sentence in these cases is six months. A mandatory minimum fine of $1,000 will also apply.
  • Third Offense Within Five to 10 Years: The mandatory minimum sentence in these cases is 90 days, and the mandatory minimum fine is $1,000.
  • Fourth or Subsequent Offense Within 10 Years: The mandatory minimum sentence for someone with three previous DUI convictions is one year. The mandatory minimum fine is $1,000.

A second DUI/DWI offense will result in a three-year driver's license suspension. Any subsequent DUI convictions will result in the revocation of a driver's license for an indefinite period.
